Abstract: Abstract: The politics of law that ignore the aspirations of society has led to inconsistency in the application of the law because of the differences between the will of the people with the legislation. This study specifically examines the political law in terms of the application of Islamic law in Indonesia which is envisaged in Law No. 1/1974 on Marmage and the Law 7/1989 on Religious Courts (and its amendment Law No. 3/2006). The political situation that characterizes the formation of the Marriage Law and the Law on Religious Courts clearly show trends and policy direction of the state law. It can be seen from the political aspects of the legal establishment, the political aspects of the content of the law (principles and the rule of law), and political aspects of law enforcement. These three aspects have made Islamic law practiced by the Indonesian Muslim community (the living laws) in conflict with formal legal rules defined by the state. The conclusion from this study is that the legal provisions in the Mariage Law that conflict, namely: Article 2 paragraph (1), Article 7 (1), Article 31 paragraph (3) and Article 34 paragraph (1) and (2), as well as Article 42 and 43 paragraph (1). Abstract: Ecological consciousness in the mid-20th century had a direct effect on the Muslim theological view toward nature. Environmental degradation requires the awareness of all humanity to restore the world to a normal ecological ecosystem based on natural laws, including awareness based on religious texts because Western model conservation is not always in accordance with all cultures and traditions in the world. This paper explains the values contained in the Qur'an associated with ecological awareness because the Qur'an contains the teachings about nature conservation contained in its verses, ranging from problems the creation of the universe until the prohibition of destruction on the face of the earth. The concept of balance (Mizan) and the concept of Islamic Leadership (khalifah) in the Qur'an become the main principle to create social harmony and balance of nature as a foundation to form religious ethics on social life and treatment of nature ethics).

Abstract: A large number of orce cases at the Banyumas Religious Court and the Purwokerto Religious Court were filed because of domestic violence. However, the Religious Courts did not use domestic violence as the basis for granting the orce suit. In its ruling, the court only states that the grounds for orce are constant quarrels. The increasing number of orce cases indicates a change in gender relations and power relations between husband and wife in domestic life. The people of Banyumas generally have bilateral or parental kinship characteristics, and women are equal to men. This is in accordance with the Penginyongan culture, which places each in idual in an egalitarian way. The husband-and-wife relationship model in Banyumas is senior-junior partner, namely the wife's position is not only as a complement to her husband, but also as a friend, because the wife makes an economic contribution even though the main breadwinner is still the husband. However, patriarchal culture also applies in such a kinship system, so that the husband has more power than the wife because of her position as the main breadwinner. Because of the weak position of women, the Religious Courts serve as the only place for Muslim women to seek justice in order to stop violence against themselves and resolve their domestic conflicts. Filing for orce has allowed women to be active agents in determining their marital status.

Abstract: The Indonesian Constitutional Court granted part of the claim for the judicial review lawsuit on Law No. 1 of 1974 concerning Marriage for Article 7 Paragraph 1 related to the age of marriage. The article is considered discriminatory against women and is considered legalizing child marriages because the lowest age limit for women can be married is 16 years old, different from the lowest age limit for men, 19 years old. The global consensus on the need to abolish early marriage, forced marriage, and child marriage is actually made and agreed upon by UN member countries, including Indonesia. There are a number of adverse effects that can arise in child marriage, such as impacts related to health, education and economic aspects, including violations of children's rights. This paper examines the age limit of marriage in the perspective of Islamic law, which can then become state policy. Marriage is a legal act that requires the doers to meet the criteria of legal competency. Marriage also requires the responsibility of the parties to fulfill their rights and obligations, so that the aspect of maturity in marriage is a must.

Abstract: Bajapuik refers to a customary engagement (khiṭbah) of the Minangkabau Pariaman community, where the prospective bride’s family gives a certain amount of money (japuik) to the groom’s family prior to a marriage. Islamic law allows a person to give a certain amount of money or gifts in the process of engagement. However, when the engagement is revoked and the marriage fails, the status of the money given during the engagement has been much contested. This study aims to explore and understand the positive relationship between Islamic law in the bajapuik tradition and local traditions. This study focuses on the legal aspects of engagement in the bajapuik tradition viewed from Islamic law and gender analysis. A descriptive qualitative approach was adopted with the primary data obtained through interviews. Data analysis was carried out using a legal approach, a sociological approach, and a philosophical approach. This study concludes that the bajapuik tradition depicts women as having a higher position than men. For the Pariaman community in Cirebon, the annulment of an engagement (khiṭbah) is a disgrace to tradition. An engagement is considered as a legally binding contract. In other words, customary provisions have coercive power to bounded communities. If an engagement is revoked without a valid reason, the responsible person can be sued for breaking the contract with certain compensations. Morevover, when a dispute occurs over property or finances, Minangkabau customary law allows the aggrieved party to take action against the khiṭbah violators in the form of returning property or money.

Abstract: Indonesia is a country with a majority Muslim population that implements a democratic system. Based on this democratic system, non-muslims constitutional systems can coexist and play an active role in carrying out religious values in the public sphere as a very visible feature. Nonetheless, the relationship between Islam and the state in the course of Indonesian history always experiences ups and downs. In one period of Indonesian history, Islamic politics was a peripheral thought and movement and even considered a threat to democracy and the value of modernity, because Islamic groups struggled to maintain the ideology of Islamism with the aim of establishing an Islamic state, or at least implementing a traditional Islamic legal system to a modern Indonesian society. However, as the development of the Islamic world coincided with efforts to democratize the Indonesian state, Islamic politics also changed its direction to adjust to these conditions. Islamic groups become more accommodating to the values of democracy and modernity, without having to leave their Islamic identity. This last phenomenon is known as post-Islamism as a socio-political movement in the life of the nation and state in Indonesia.

Abstract: Abstract: Achieving equal opportunities between women and men in political competition has always been a complex process, even though the government has established affirmative policies to encourage a greater role for women in the political sphere. The issue of patriarchal culture and the challenge of religious conservatism can h er the achievement of the objectives of the affirmation policy for women in competing for elections to occupy the position of parliament members (DPR-RI). This paper discusses the political contestation of women in reaching political positions as people's representatives and the challenges they face in fighting for issues of gender equality in the parliament. This research answers what factors are h ering women's involvement in political contestation, and what challenges are there in fighting for gender equality issues. This study used a qualitative method with a descriptive analysis approach. The theory used in this study was the concept of affirmative action and the theory of gender equality in politics. The results of the discussion showed that the number of women elected in the 2019 Elections increased. Thanks to the affirmative policy ruled by the Indonesian government. However, affirmative policies to meet gender quotas do not only benefit those who have gender equality agendas, but also those who stand with the anti-feminist movement that represents the voices of conservative groups. The issue they are fighting for is still trapped in the gender ideology proclaimed by a patriarchal culture, which assumes women's problems are identical to those of mothers. Therefore, not all elected women MPs explicitly have a gender perspective. الملخص:إن تحقيق تكافؤ الفرص بين النساء والرجال في المنافسة السياسية كان دائمًا عملية معقدة ، على الرغم من أن الدولة وضعت سياسات إيجابية لتشجيع دور أكبر للمرأة في المجال السياسي.يمكن أن تعوق مسألة الثقافة الأبوية وتحدي المحافظة الدينية تحقيق أهداف سياسة التأكيد للمرأة في التنافس على الانتخابات لشغل منصب أعضاء البرلمان (مجلس النواب لجمهورية إندونيسيا). تناقش هذه الورقة التنافس السياسي للمرأة في الوصول إلى المناصب السياسية كممثلة للشعب والتحديات التي تواجهها في الكفاح من أجل قضايا المساواة بين الجنسين في البرلمان.يجيب هذا البحث عن العوامل التي تعوق مشاركة المرأة في التنافس السياسي ، والتحديات التي تواجهها النساء في الكفاح من أجل قضايا المساواة بين الجنسين. تستخدم هذه الدراسة طريقة نوعية مع نهج التحليل الوصفي.النظرية المستخدمة في هذه الدراسة هي مفهوم العمل الإيجابي ونظرية المساواة بين الجنسين في السياسة. تظهر نتائج البحث أن عدد النساء المنتخبات في انتخابات 2019 زاد بنسبة 22 في المائة. بفضل السياسة الايجابية التي تحكمها الحكومة الاندونيسية.ومع ذلك ، فإن السياسات الإيجابية للوفاء بحصص النوع الاجتماعي لا تفيد فقط أولئك الذين لديهم أجندة للمساواة بين الجنسين ، ولكن أيضًا أولئك الذين يقفون إلى جانب الحركة المناهضة للنسوية التي تمثل أصوات الجماعات المحافظة.إن القضية التي يناضلون من أجلها لا تزال عالقة في الأيديولوجية الجنسانية التي أعلنتها ثقافة أبوية ، والتي تفترض أن مشاكل المرأة مماثلة لمشاكل الأمهات.لذلك ، لم يكن لجميع البرلمانيات المنتخبات منظور جنساني بشكل واضح.Abstrak: Mencapai peluang yang setara antara perempuan dan laki-laki dalam persaingan politik selalu menjadi proses yang kompleks, meskipun negara telah menetapkan kebijakan afirmatif untuk mendorong peran yang lebih besar bagi perempuan dalam ranah politik. Persoalan budaya patriarkal dan tantangan konservatisme agama dapat menghambat pencapaian tujuan kebijakan afirmasi bagi perempuan dalam memperebutkan pemilihan untuk menduduki posisi anggota DPR-RI. Kajian ini membahas kontestasi politik perempuan dalam mencapai posisi sebagai wakil rakyat dan tantangan yang mereka hadapi dalam memperjuangkan isu-isu kesetaraan gender di parlemen. Penelitian ini menjawab faktor-faktor apa yang menghambat keterlibatan perempuan dalam kontestasi politik, dan tantangan apa yang dihadapi perempuan dalam memperjuangkan isu kesetaraan gender. Penelitian ini menggunakan metode kualitatif dengan pendekatan analisis deskriptif. Teori yang digunakan dalam penelitian ini adalah konsep affirmative action dan teori kesetaraan gender dalam politik. Hasil kajian menunjukkan bahwa jumlah perempuan yang terpilih dalam Pemilu 2019 meningkat 22 persen berkat kebijakan afirmatif yang ditetapkan oleh pemerintah. Namun demikian, kebijakan afirmatif untuk memenuhi kuota perempuan tidak hanya menguntungkan mereka yang memiliki agenda kesetaraan gender, tetapi juga mereka yang mendukung gerakan anti-feminis yang mewakili suara-suara kelompok konservatif. Masalah yang mereka perjuangkan masih terjebak dalam ideologi gender yang diproklamasikan oleh budaya patriarki, yang menganggap masalah perempuan identik dengan masalah ibu. Karena itu, tidak semua anggota parlemen perempuan yang terpilih secara eksplisit memiliki perspektif gender.

Abstract: span Legal politics are inextricably linked to power politics. Political dynamics in Indonesia are always colored by the dynamics of Islamic politics, as most Indonesians' political aspirations are influenced by Islamic views. This paper examines the evolution of Islamic law in the modern Indonesian democratic system, particularly after the reform era. Indonesia's democratisation gave rise to freedom of expression and opinion. Even today, Islamic conservatism is growing in Indonesia, but this does not mean that radical Islamist groups are gaining strength. Many political organisations, including Islamic parties and other Islamic movements, have liberated themselves and broadened their organisational philosophies in order to address broader issues and concerns. While maintaining their Islamic identity, some Islamic groups are turning towards the secularization of their goals and objectives as a means of adapting to the changing political environment. Political analysts refer to this development as post-Islamism. The current direction of Islamic politics is more accommodating aspects of democracy but still highlights its Islamic sides. This makes the government more accommodative to laws and regulations based on Islamic teachings. /span span em span Politik hukum tidak lepas dari aspek-aspek politik kekuasaan. Di Indonesia, dinamika politik juga tidak lepas dari politik Islam, karena aspirasi politik sebagian besar masyarakat Indonesia dipengaruhi oleh pandangan Islam. Makalah ini membahas tentang perkembangan hukum Islam dalam sistem demokrasi Indonesia kontemporer, terutama setelah masa reformasi. Demokratisasi Indonesia memunculkan kebebasan berpendapat dan berekspresi. Bahkan saat ini konservatisme Islam di Indonesia semakin meningkat, namun hal itu bukan berarti menguatnya kelompok Islamis radikal. Banyak organisasi politik termasuk partai Islam dan gerakan-gerakan Islam lainnya melakukan pembebasan diri dan melakukan keterbukaan filosofi organisasi mereka untuk mengakomodasi berbagai masalah dan keprihatinan yang lebih luas. Sambil mempertahankan identitas keislamannya, beberapa kelompok Islam beralih ke arah sekularisasi tujuan dan sasaran mereka sebagai sarana untuk beradaptasi dengan lingkungan politik yang berubah. Analis politik menyebut perkembangan ini sebagai post-Islamisme. Arah politik Islam saat ini lebih mengakomodasi aspek-aspek demokrasi namun tetap menonjolkan sisi keislamannya. Hal ini membuat pemerintah lebih bersikap akomodatif terhadap peraturan perundang-undangan yang berlandaskan ajaran Islam. /span /em /span

Abstract: Mediation as a dispute resolution process outside the courtroom has been used by the Religious Courts. Its juridical basis is based on Indonesian Supreme Court Regulations Number 2 of 2003 and Number 1 of 2008 concerning Mediation Procedures in Courts. Meanwhile, in the classical Islamic legal tradition, marital conflicts are resolved by a third party outside the courtroom which is referred to as ṣulḥ, namely efforts to reconcile through a process of taḥkīm or arbitration. Based on this, this study answers the question whether the Religious Courts in Indonesia fully use the concept of ṣulḥ as a process of resolving marital conflicts as depicted in the classical Islamic legal tradition. This study concludes that the Religious Courts in Indonesia do not fully use the concept of ṣulḥ as a process of resolving marital conflicts as depicted in the classical Islamic legal tradition. This is because the concept of ṣulḥ in Islamic law uses the taḥkīm (ḥakam) mechanism. The concept of ḥakam originating from the classical Islamic legal tradition and mediation originating from the contemporary national legal tradition actually both have substantial differences in terms of concept and implementation in the Religious Courts. The difference in concept is due to differences in sources, authorities, and procedures. However, there are similarities between the two, which lie in the involvement of someone who plays a role in resolving disputes and conflicts in court.

Abstract: This research departs from a paradigm that the freedom of judges is a form of court independence, which requires that decisions taken must consider objectivity without pressure from any party. This study focuses on the attitude of judges' independence from factors that can influence court decisions, both internal and external factors related to the interests of certain groups. Based on these problems, this study addresses the issue of the independence of judges in cases of blasphemy. This type of research is empirical normative with a qualitative descriptive approach. The data sought for this research is data that comes from the facts of the application of material and formal law by judges in court. In addition, this data is also strengthened by interviews. This study concludes that the analysis of the application of the blasphemy article proves that judges as law enforcers have difficulty translating the substance of blasphemy because of the unclear formulation of Article 156a letter 'a' of the Indonesian Criminal Code. The judge's decision in the blasphemy case does not reflect the independence values of the judges who decide the case. Judges in making decisions on cases handled must be based on their ability to think and will freely (independently) but within the limitations of responsibility and objectivity. The panel of judges in blasphemy cases tends to adopt a more general and situation-oriented attitudes.

Abstract: Islam is a religion which has attempted to elevate the status of women so that there should be no discrimination between women and men from the Islamic perspective. However, in some fiqh texts, which are based on selected Qur'an and hadith, there is discrimination against women. On the other side, gender discourse now becomes an important issue and is used to improve the status of women. This article attempts to explore both the jiqh texts and gender discourse on the models of leadership in a family, especially on the role of women and men in the family and on the sexual relations, from the Islamic perspective.

Abstract: Makalah ini membahas jaminan kebebasan beragama dalam konstitusi dua negara, yaitu Indonesia dan Malaysia, dan apakah judicial review bisa menjadi mekanisme terbaik untuk melindungi hak konstitusional warganegara dari kedua negara tersebut. Makalah ini berkesimpulan bahwa Indonesia dan Malaysia memiliki karakteristik konstitusi yang berbeda dalam hal ketentuan-ketentuan perlindungan kebebasan beragama. Namun demikian, judicial review di kedua negara tersebut bisa menjadi perlindungan bagi hak-hak agama minoritas, meskipun dalam prakteknya tidak selalu demikian, seperti dalam kasus judicial review undang-undang anti penodaan agama di Indonesia. Memang idealnya, judicial review merupakan cara yang paling efektif dalam menguji undang-undang yang merugikan kaum minoritas, dan juga judicial review seharusnya diletakkan sebagai faktor penting untuk melindungi hak asasi manusia.

Abstract: Islam in Indonesia is culturally very different from that in the Middle East, particularly related to a tradition of greater freedom for women in public places. In Indonesia, there are many women entering public and political arena and even women are seeking and achieving unprecedented power and influence in public life. However, there are some barriers from religion and culture that give burdens to women to express their political views and to involve in public life. Very often women who want to enter politics find that the political and public environment is not conducive to their participation. This paper discusses cultural, religious, and political factors of the difficulties faced by Indonesian Muslim women to participate freely in public and political lives. This paper looks at how women’s status in cultural and social structure influences the involvement of women in political activities. This study is a philosophical investigation of the value of culture, religion, and politics to Indonesian women in democratic practices. With the use of intensive reading of books and other information sources, together with policy document analysis, the study aims to explore the problems and possibilities of putting the visions of democracy into practice in contemporary Indonesian women, to explore the nature of culture, religion, and politics in Indonesia in influencing women’s political activism, and to understand both the status of Muslim women and the dynamics of Muslim societies in Indonesia. This paper concludes that women are still under-represented in public and political institutions in Indonesia. The long struggle of women’s movement for equal rights has not been easy due to the cultural and religious reasons.

Abstract: Selama ini kajian al-Ahwal asy-Syakhsiyah seringkali hanya didasarkan pada ketentuan-ketentuan yang diambil dari kitab-kitab fiqih saja sehingga ia dikaji dengan tanpa melihat makna filosofis di dalamnya. Makalah ini melakukan kajian terhadap al-Ahwal asy-Syakhsiyah, yang merupakan studi di bidang hukum keluarga. Kajian ini perlu dilakukan agar aspek legal reasoning (proses ijtihad) dalam istinbat hukum bidang ini bisa dilihat secara cermat. Karena itulah pendekatan tujuan hukum (maqasid asy-syari’ah) penting digunakan agar penerapan hukum Islam dapat diarahkan untuk membentuk suatu tatanan masyarakat yang didasarkan pada kebaikan dan keadilan serta bersih dari kerusakan dan ketimpangan sosial. Urgensi aspek filosofis dan sosiologis dalam kajian ini terlihat pada penggunaan analisis d ak hukum (an-nazar fi al-ma’alat) dalam upaya penggalian maqasid asy-syari’ah. Penerapan metode ini bisa dilihat dalam kasus penentuan hukum pernikahan dengan ahli kitab, persaksian dalam talak, dan wasiat wajib.
