Abstract: This paper investigates what "free-range" eggs are available for sale in supermarkets in Australia, what "free-range" means on product labelling, and what alternative "free-range" offers to cage production. The paper concludes that most of the "free-range" eggs currently available in supermarkets do not address animal welfare, environmental sustainability, and public health concerns but, rather, seek to drive down consumer expectations of what these issues mean by balancing them against commercial interests. This suits both supermarkets and egg producers because it does not challenge dominant industrial-scale egg production and the profits associated with it. A serious approach to free-range would confront these arrangements, and this means it may be impossible to truthfully label many of the "free-range" eggs currently available in the dominant supermarkets as free-range.

Abstract: The Open Corporation, originally published in 2002, set out a blueprint for effective corporate self-regulation, offering practical strategies for managers, stakeholders and regulators to build successful self-regulation management systems. Christine Parker examined the conditions under which corporate self-regulation of social and legal responsibilities were likely to be effective, covering a wide range of areas - from consumer protection to sexual harassment to environmental compliance. Focusing on the features that make self-regulation or compliance management systems effective, Parker argued that law and regulators needed to focus much more on 'meta-regulating' corporate self-regulation if democratic control over corporate action was to be established.

Abstract: Compliance-oriented regulation should be understood as a holistic approach to regulatory design, implementation, monitoring, and enforcement in which the guiding principle is the achievement of regulatory outcomes. Compliance-oriented regulation is therefore distinctively concerned with the effects of public regulation in preexistent regulatory space where it must compete with private normative orderings. This article sets out the principles of compliance-oriented regulatory innovation together with evidence on their effectiveness. The widespread implementation of in-house corporate compliance systems in recent years means that compliance-oriented regulators need to be particularly concerned with nurturing compliance capacity among regulatees, fostering regulatory community through compliance professionalism, and developing standards for corporate compliance functions.

Abstract: There is growing recognition that current food systems are both unhealthy and unsustainable, and are increasingly shifting toward the supply and marketing of unhealthy, ultra-processed foods and beverages. Large food companies hold substantial power within food systems and present a significant barrier to progress on addressing issues related to nutrition and obesity prevention. Institutional investors (such as pension funds) play a key role in influencing corporate governance and practices, and are increasingly incorporating environmental, social and governance (ESG) considerations within investment decisions. By considering nutrition and obesity prevention, institutional investors present a potential avenue for driving increased food industry accountability for their population health impact. This study investigated views of stakeholders in the Australian investment sector on the incorporation of nutrition and obesity prevention considerations within institutional investment decision-making regarding food companies. Fifteen in-depth, semi-structured interviews were conducted in 2020-21. Participants were predominantly Australian-based, and included representatives from asset management companies, superannuation funds, ESG advisory/consultancy firms, ESG research providers, and relevant advocacy groups. Interviews examined challenges and opportunities to the integration of nutrition and obesity prevention considerations within institutional investment decision-making. Interviews were analysed using deductive thematic analysis, informed by a theoretical change model. Several participants reported that their institution factored nutrition and obesity prevention considerations into their investment decisions however, attention to nutrition-related issues was limited, generally perceived as ‘niche’, and not yet institutionalised. Key challenges and opportunities were identified at the employee, investment organisation, investment sector, government and non-government levels. These challenges and opportunities centred around experience and knowledge, quality and availability of ESG data and benchmarks, importance of investor coalitions, and demonstration of financial risks related to nutrition and obesity. There are a range of steps that could be taken to help ensure more systematic and effective consideration of issues related to nutrition and obesity prevention within institutional investment decision-making in Australia, including: (1) improved nutrition-related reporting metrics and benchmarking criteria for food companies (2) better articulation of the financial risks that unhealthy diets and obesity pose to investors (3) enhanced investor advocacy on unhealthy diets and obesity through investor coalitions and (4) detailed guidance for investors on how to address unhealthy diets and obesity. Better engagement between the Australian public health community, institutional investors and government regulators is critical to drive changed investor practice in this area.

Who has a beef with reducing red and processed meat consumption? A media framing analysis

Abstract: Diets high in red and processed meat (RPM) contribute substantially to environmental degradation, greenhouse gas emissions and the global burden of chronic disease. High-profile reports have called for significant global RPM reduction, especially in high-income settings. Despite this, policy attention and political priority for the issue are low. The study used a theoretically guided framing analysis to identify frames used by various interest groups in relation to reducing RPM in online news media articles published in the months around the release of four high-profile reports by authoritative organisations that included a focus on the impacts of high RPM production and/or consumption. Four major RPM producing and consuming countries – USA, United Kingdom, Australia and New Zealand. None. Hundred and fifty news media articles were included. Articles reported the views of academics, policymakers, industry representatives and the article authors themselves. RPM reduction was remarkably polarising. Industry frequently framed RPM reduction as part of a ‘Vegan Agenda’ or as advocated by an elite minority. Reducing RPM was also depicted as an infringement on personal choice and traditional values. Many interest groups attempted to discredit the reports by citing a lack of consensus on the evidence, or that only certain forms of farming and processing were harmful. Academics and nutrition experts were more likely to be cited in articles that were aligned with the findings of the reports. The polarisation of RPM reduction has led to a binary conflict between pro- and anti-meat reduction actors. This ision may diminish the extent to which political leaders will prioritise this in policy agendas. Using nuanced and context-dependent messaging could ensure the narratives around meat are less conflicting and more effective in addressing health and environmental harms associated with RPM.

The Extent to Which Obesity and Population Nutrition Are Considered by Institutional Investors Engaged in Responsible Investment in Australia - A Review of Policies and Commitments

Abstract: Responsible investment (RI), in which environmental, social and governance (ESG) considerations are incorporated into investment decision making, is a potentially powerful tool for increasing corporate accountability and improving corporate practices to address broad societal challenges. Whilst the RI sector is growing, there is limited understanding of the extent to which pressing social issues, such as obesity and unhealthy population diets, are incorporated within RI decision making. This study aimed to investigate the extent to which obesity prevention and population nutrition are considered by Australian institutional investors engaged in responsible investment. A desk-based review was conducted of investment approaches of prominent Australian asset managers and superannuation funds identified as engaged in responsible investment. Relevant information on the incorporation of ESG issues related to obesity and population nutrition was extracted for each investor, drawing on websites, published policy documents and annual reports. Strategies were categorized as: (1) negative/exclusionary screening (2) positive/best-in-class screening (3) norms-based screening (4) ESG integration (5) sustainability-themed investing (6) impact/community investing and (7) corporate engagement and shareholder action. These strategies were compared across investors and by themes related to obesity and population nutrition. Eighteen of the 35 investors indicated that they applied investment strategies that considered issues related to obesity and population nutrition. The most commonly identified strategy was ESG integration ( n = 12), followed by sustainability-themed investing ( n = 6), and positive screening ( n = 4). The ways in which obesity and population nutrition were considered as part of these approaches included relatively high-level general health considerations ( n = 12), considerations around the healthiness of food company product portfolios ( n = 10), and consideration of specific company nutrition policies and practices ( n = 4). The specificity and depth to which RI strategies were disclosed varied. There is significant potential for investment decisions to contribute to efforts to address key social issues, such as obesity and unhealthy diets. Some institutional investors in Australia have recognized the potential importance of incorporating obesity- and population nutrition-related issues into decision-making processes. However, the extent to which these considerations translate into investment decisions and their impact on companies in the food sector warrant further exploration.
Ecological regulation for healthy and sustainable food systems: responding to the global rise of ultra-processed foods

Abstract: Many are calling for transformative food systems changes to promote population and planetary health. Yet there is a lack of research that considers whether current food policy frameworks and regulatory approaches are suited to tackle whole of food systems challenges. One such challenge is responding to the rise of ultra-processed foods (UPF) in human diets, and the related harms to population and planetary health. This paper presents a narrative review and synthesis of academic articles and international reports to critically examine whether current food policy frameworks and regulatory approaches are sufficiently equipped to drive the transformative food systems changes needed to halt the rise of UPFs, reduce consumption and minimise harm. We draw on systems science approaches to conceptualise the UPF problem as an emergent property of complex adaptive food systems shaped by capitalist values and logics. Our findings reveal that current food policy frameworks often adjust or reform isolated aspects of food systems (e.g., prices, labels, food composition), but under-emphasise the deeper paradigms, goals and structures that underlie the rise of UPFs as a systems phenomenon, and its socio-ecological implications. We propose that a ‘leverage points’ framework illuminates where to intervene in food systems to generate multi-level changes, while the theory of ecological regulation highlights how to respond to complex multi-factorial problems, like the rise of UPFs, in erse ways that respect planetary boundaries. More research is needed to better understand the transformative potential of ecological regulation to advance food systems transformation and attenuate whole of food systems challenges.

Abstract: A number of countries, including Australia, have recently drastically increased the sanctions available for cartel conduct, on the assumption that businesses make decisions about their regulatory compliance behavior on the basis of self-interested calculations about the costs and gains of that behavior. Policymakers often assume that higher sanctions will automatically mean greater deterrence and therefore more compliance. This article sets out a more holistic model of calculative thinking about the costs and gains of compliance and noncompliance. We go on to test this model using data about business firms' compliance management responses to Australia's competition and consumer protection law. We find that enforcement probability is more important than sanction severity, that business belief in the positive business case for compliance is also important, and that fundamental firm characteristics (size, resources, and management style) are also significantly and independently related to compliance management behavior. We conclude that higher sanctions on their own are unlikely to lead to higher compliance with Australian competition and consumer protection law.

Abstract: This article argues that banks should adopt animal welfare policies in the light of the growing acceptance of the need for ‘responsible banking’, which incorporates environmental, social, and governance analysis into credit risk and due diligence processes. The responsibility of banks for animal welfare is underscored by the drive towards greater investment in animal agribusiness, and the vicious cycle through which animal agribusiness can both contribute to, and be impacted by, climate disruption. The article evaluates, through a desktop review, how leading Australian retail banks and agribusiness lenders are addressing animal welfare and climate disruption in animal agribusiness lending. We find that although most banks have made a commitment to animal welfare and climate policies, these often amount to little more than greenwashing. We call for an ecosystem of industry, regulatory, and civil society action to address this danger.

Abstract: This paper provides a systematic account of how artificial intelligence (AI) technologies could harm nonhuman animals and explains why animal harms, often neglected in AI ethics, should be better recognised. After giving reasons for caring about animals and outlining the nature of animal harm, interests, and wellbeing, the paper develops a comprehensive ‘harms framework’ which draws on scientist David Fraser’s influential mapping of human activities that impact on sentient animals. The harms framework is fleshed out with ex les inspired by both scholarly literature and media reports. This systematic account and framework should help inform ethical analyses of AI’s impact on animals and serve as a comprehensive and clear basis for the development and regulation of AI technologies to prevent and mitigate harm to nonhumans.

Abstract: This paper asks what the regulatory assessment of the novel processed meat analogue products reveals about the nature of food regulation in Australia. We analyse Food Standards Australia and New Zealand’s (‘FSANZ’) assessment of the recent application by Californian technology company Impossible Foods Inc to sell its proprietary burger products which contain a genetically modified protein that is said to make their burger ‘bleed’. We show that FSANZ’s assessment process has little capacity to engage with broader and longer term, social, ecological and public health implications of novel foods and changing food markets. FSANZ’s regulatory pre-approval process focuses almost exclusively on the safety of in idual ingredients rather than the impact of novel foods on the food supply as whole and leaves broader issues to the market and consumer choice with limited support from laws addressing misleading labelling and marketing of foods. Extending the capacity of Australia’s regulatory regime for food to deal with more than the safety of in idual ingredients will become more urgent as other novel foods, such as cell-based meats, enter the marketplace.
Unlocking the Energy of the Amazon? The need for a Food Fraud Policy approach to the Regulation of Anti-ageing Health Claims on Superfood Labelling

Abstract: The prevention and control of ‘food fraud’, including false or misleading statements made about a product for economic gain, is now emerging as an important and discrete policy goal for governments and regulators in the interface between food and public health. The control and prevention of food fraud complements regulation to ensure microbial food safety. This article uses a case study of anti-ageing claims made in the labelling and advertising of açai berry superfood products to argue that Australia's new regulatory system for nutrient content and health claims on food (Australia and New Zealand Food Standards Code Standard 1.2.7) inadequately addresses ‘food fraud’. This article argues that the over-reaching claims on açai product labelling will potentially mislead consumers and subvert public health messages in a context of ‘gastro-anomy’ (confusion over appropriate norms for eating) and ‘healthism’ (in idual responsibility for making healthy choices). This conduct can usefully be conceptualised as food fraud. Second, the article argues that although the substance of Standard 1.2.7 is well designed to avoid food fraud, the fact that the standard allows food businesses to self-substantiate evidence when making some health claims undermines the protection offered. Australian food regulators need to articulate a more strategic and proactive approach to the prevention and control of food fraud.

Abstract: This article argues that the growth of free-range labelled egg and chicken shows that the public wish to buy foods produced via higher welfare standards. It summarises the main reasons for dissatisfaction with the current regulation of animal welfare standards in Australia and shows that labelling for consumer choice is not enough to address public concerns. It critically evaluates the degree to which recently proposed new animal welfare standards and guidelines for poultry would address these problems and concludes that the new standards are not sufficient and that more responsive, effective and independent government regulation of animal welfare is required.

Sustainable Healthy Food Choices: The Promise of 'Holistic' Dietary Guidelines as a National and International Policy Springboard

Abstract: A healthy diet is generally a sustainable diet. This point is illustrated in the large body of work exploring the interconnections between public health nutrition and environmental issues associated with food choices. Unhealthy diets and their contribution to diet-related noncommunicable diseases (NCDs) are receiving growing attention from international and national policy-makers. Dietary guidelines that inform consumers about food choices and that shape policy actions to enable choices in line with the guidelines are foundational to both national and international responses to diet-related NCDs. The purpose of this paper is to argue for holistic dietary guidelines as part of national and international policy responses to diet-related NCDs. Holistic dietary guidelines simultaneously address health and environmental sustainability to address common causes and harness synergistic solutions. They are based on evidence, and free of conflicts of interest. Moreover, they act as a policy springboard for effective regulatory action to change the food environment and not just as an education tool. Holistic dietary guidelines raise potential concerns under international trade and investment law, for ex le, to the extent that such guidelines promote local products as a means of supporting both nutritional and environmental health. These issues will be examined in more depth in a second paper in this special issue that follows on from this one.
Corporate compliance systems: could they make any difference?

Abstract: This article critically appraises the potential of corporate compliance systems to influence corporate behavior. The authors differentiate between the adoption of formal compliance management systems and the way compliance is managed in practice in business organizations by reference to scholarly literature and analysis of survey responses from 999 large Australian businesses about their implementation of competition and consumer protection law compliance systems. Their analysis shows that at least some elements of compliance systems can translate into good management of compliance in practice. But management commitment to compliance values, managerial oversight and planning, and organizational resources are just as important.

Abstract: Background: One important way to transform food systems for human and planetary health would be to reduce the production and consumption of animals for food. The over-production and over-consumption of meat and dairy products is resource-intensive, energy-dense and creates public health and food equity risks, including the creation of superbugs and antimicrobial resistance, contamination and pollution of land and waterways, and injustice to animals and humans who work in the sector. Yet the continuing and expanding use of animals is entrenched in food systems. One policy response frequently suggested by parties from all sectors (industry, government and civil society) is voluntary or mandatory labelling reforms to educate consumers about the healthiness and sustainability of food products, and thus reduce demand. This paper evaluates the pitfalls and potentials of labelling as an incremental regulatory governance stepping-stone to transformative food system change. Methods: We use empirical data from a study of the regulatory politics of animal welfare and environmental claims on Australian products together with an ecological regulation conceptual approach to critically evaluate the potential of labelling as a regulatory mechanism. Results: We show that labelling is generally ineffective as a pathway to transformative food system change for three reasons: it does not do enough to redistribute power away from dominant actors to those harmed by the food system it is vulnerable to greenwashing and reductionism and it leads to market segmentation rather than collective political action. Conclusion: We suggest the need for regulatory governance that is ecological by design. Labelling can only be effective when connected to a broader suite of measures to reduce overall production and consumption of meat. We conclude with some recommendations as to how public health advocates and policy entrepreneurs might strategically use and contest labelling and certification schemes to build support for transformative food system change and to avoid the regressive consequences of labelling.
Understanding the Political Challenge of Red and Processed Meat Reduction for Healthy and Sustainable Food Systems: A Narrative Review of the Literature

Abstract: Background: Diets high in red and processed meat (RPM) contribute substantially to environmental degradation, greenhouse gas (GHG) emissions, and the global burden of chronic disease. Recent high-profile reports from international expert bodies have called for a significant reduction in global dietary meat intake, particularly RPM, especially in high-income settings, while acknowledging the importance of animal-sourced foods to population nutrition in many lower-income countries. However, this presents a major yet under-investigated political challenge given strong cultural preferences for meat and the economic importance and power of the meat industry. Methods: A theoretically-guided narrative review was undertaken. The theoretical framework used to guide the review considered the interests, ideas and institutions that constitute food systems in relation to meat reduction and the instrumental, discursive and structural forms of power that actors deploy in relation to others within the food system. Results: High production and consumption levels of RPM are promoted and sustained by a number of factors. Actors with an interest in RPM included business and industry groups, governments, intergovernmental organisations, and civil society. Asymmetries of power between these actors exist, with institutional barriers recognised in the form of government-industry dependence, trade agreement conflicts, and policy incoherence. Industry lobbying, shaping of evidence and knowledge, and highly concentrated markets are key issues. Furthermore, prevailing ideologies like carnism and neoliberalism present embedded difficulties for RPM reduction. The literature noted the power of actors to resist meat reduction efforts exists in varying forms, including the use of lobbying, shaping of evidence and knowledge, and highly concentrated markets. Conclusion: There are a number of political challenges related to RPM reduction that contribute to policy inertia, and hence are likely to impede the transformation of food systems. Research on policy efforts to reduce RPM production and consumption should incorporate the role of power and political feasibility.

Abstract: Alternative proteins, including plant-based and cell-based meat and dairy analogues, are discursively positioned as a new form of meat and dairy and as a solution to the myriad of issues associated with conventional animal agriculture. Animal agricultural industries across various nations have resisted this positioning in regulatory spaces by advocating for laws that restrict the use of meat and dairy terms on the labels of alternative proteins products. Underlying this contestation are differing understandings of, and vested interests in, desirable futures for animal agriculture. In Australia, this broader contestation led to a national-level inquiry by a Senate parliamentary committee entitled Definitions of meat and other animal products (the Inquiry). This paper reports findings from a study of the problematizations developed through the Inquiry using a framework for policy discourse analysis referred to as Bacchi’s ‘What’s the Problem Represented to be’ methodology. It shows how the dominant discourse throughout the Inquiry moved away from the initial problematization of alternative proteins as a threat to animal agriculture. Instead, both industries were ultimately positioned as not in competition and only labelling laws were problematized with the solution being amendments to ensure ‘consumer clarity’. This outcome ignored a range of alternative problematizations related to the ethical, environmental, health, social and economic issues raised by animal agriculture and by alternative proteins. This lack of scrutiny benefits both industries, by closing off the policy discourse to consideration of a range of alternative interests, voices, and potential solutions, such as stricter health and welfare regulation.

Abstract: The WHO End-TB Strategy calls for the development of novel diagnostics to detect tuberculosis (TB) earlier and more accurately. Better diagnostics, together with tools to predict disease progression, are critical for achieving WHO End-TB targets. The E arly R isk A ssessment in TB Contacts by new diagno S tic t E sts (ERASE-TB) study aims to evaluate novel diagnostics and testing algorithms for early TB diagnosis and accurate prediction of disease progression among household contacts (HHCs) exposed to confirmed index cases in Mozambique, Tanzania and Zimbabwe. A total of 2100 HHCs (aged ≥10 years) of adults with microbiologically-confirmed pulmonary TB will be recruited and followed up at 6-month intervals for 18–24 months. At each time point, a WHO symptom screen and digital chest radiograph (dCXR) will be performed, and blood and urine s les will be collected. In iduals screening positive (WHO symptom screen or dCXR) will be requested to provide sputum for Xpert MTB/Rif Ultra. At baseline, HHCs will also be screened for HIV, diabetes (HbA1c), chronic lung disease (spirometry), hypertension and anaemia. Study outcomes will be coprevalent TB (diagnosed at enrolment), incident TB (diagnosed during follow-up) or no TB at completion of follow-up. Novel diagnostics will be validated using fresh and biobanked s les with a nested case–control design. Cases are defined as HHCs diagnosed with TB (for early diagnosis) or with incident TB (for prediction of progression) and will be matched by age, sex and country to HHCs who remain healthy (controls). Statistical analyses will include assessment of diagnostic accuracy by constructing receiver operating curves and calculation of sensitivity and specificity. ERASE-TB has been approved by regulatory and ethical committees in each African country and by each partner organisation. Consent, with additional assent for participants years, is voluntary. Attestation by impartial witnesses is sought in case of illiteracy. Confidentiality of participants is being maintained throughout. Abstract: The success of competition and accountability reform to the Australian legal profession is found to be as dependent on the process by which it is introduced as on its substantive merits. A ersity of opinions on, and experiences of, reform proposals was gathered through interviews with forty-one lawyers selected by the difference discovery method. Their varied responses to reform were analysed using the constant comparative method and placed into two broad categories: (a) conversion stories based on community responsiveness, persuasive dialogue, discovery of self-interest, pragmatic acceptance of fate and surrender to market forces and (b) defiance stories induced by discredit and disrespect. It was found that in idual lawyers and professional associ ations have responded constructively to persuasion and dialogue especially when they also see reform as inevitable. They have resisted when change is introduced in a way that denies them a role in their own regulation and reform.
Promoting a healthier, younger you: The media marketing of anti-ageing superfoods

Abstract: The growing availability of products labelled ‘superfoods’ has been a major marketing success story. While little scientific evidence supports the claims regarding the health-enhancing, age-defying benefits to be derived from the consumption of superfoods, marketers have been able to effectively promote these products for what they promise. This article explores the pedagogic role performed by media in marketing ‘superfoods’ in the contemporary context of food normlessness (‘gastro-anomy’). Using Foucault’s ideas on the workings of power and governance and drawing on data from an analysis of Australian media items on superfoods published between 1995 and 2014, the article reveals the techniques by which superfoods are promoted as the means for fashioning a healthier, younger self. It is argued that ‘superfoods’ is an ill-defined, ambiguous category, whose marketing is assisted through the confounding and confusing of news and advertising in media coverage, and the extensive use of promissory statements, scientific claims and personal forms of address that connect directly with audiences. We conclude by observing that while citizens may seek to live their lives according to the ideals of healthism, the media serves as a platform to promote neoliberal norms and values, such as consumer choice, accountability and the anxiety that goes along with them and that feeds the pursuit of ‘superfoods’.

Abstract: Labeling and information disclosure to support consumer choice are often proposed as attractive policy alternatives to onerous mandatory business regulation. This article argues that choices available to consumers are constructed and constrained by actors in the chains of production, distribution, and exchange who bring products to retail. It traces how “free-range” eggs come to market in Australia, finding that the “industrial free-range” label dominating the market is not substantially different from caged-egg production in the way that it addresses animal welfare, public health, and agro-ecological values. I show how the product choices available to consumers have been constructed not just by the regulation (or nonregulation) of marketing and labeling, but also by the regulatory paths taken and not taken all along the food chain.

Abstract: Regulatory capitalism—a social, political, and economic order characterized by a proliferation of both markets and state and nonstate attempts to regulate markets and business conduct—creates the opportunity for theoretically and politically significant research on compliance. The plural and decentered nature of regulation, and therefore of compliance, in regulatory capitalism creates significant complexity and difficulty for social scientists in the conceptual definition and operationalization of regulatory compliance, however. We survey the different ways in which empirical researchers have studied business compliance with regulation, and their strengths and weaknesses. In doing so, we review and interrogate the literature on regulatory compliance to understand what it is that researchers study when we study business compliance with regulation, and what we might have been missing or assuming.

Abstract: This review addresses food as a topic of sociolegal studies. We show that the ide between production and consumption in law and social science is increasingly untenable in the context of contemporary globalizing, industrializing food chains underpinned by a productivist ideology and supported by a consumptogenic cultural economy. Sociolegal studies of food are well-suited to grappling with the complexity of production–consumption dynamics through regulatory governance studies of hybridized (public and private) supply chain standards. Yet we argue for an expanded focus on the embeddedness of food chains in social, political, and, importantly, ecological food webs. We suggest that sociolegal studies into ecologically based regulation, countermovements, and an expansive version of the human right to food (that includes nature and animals) can particularly contribute to an understanding of the possibilities for regulating capitalism by seeking to constrain globalizing, industrialized food chains.
