Predictors of indigenous arrest: An exploratory study

Abstract: The Royal Commission into Aboriginal Deaths in Custody attributed Indigenous overrepresentation in the criminal justice system to Indigenous disadvantage. Others have attributed it to alcohol abuse and substance use and/or passive welfare dependence. To date, however, there has been little rigorous empirical research into the factors that distinguish Indigenous Australians who come into contact with the criminal justice system from those who do not. The study reported here uses the 2002 National Aboriginal and Torres Strait Islander Social Survey (NATSISS) to explore the correlates of Indigenous arrest. The analyses suggest that factors like economic stress, welfare dependence and unemployment are strongly correlated with whether or not an Indigenous respondent has been arrested and with the number of times an Indigenous respondent has been arrested in the past 5 years. The strongest correlate, however, is alcohol abuse. The implications of these findings for research and policy on Indigenous contact with the justice system are discussed.

The importance of understanding Indigenous employment in the Indigenous business sector

Abstract: Indigenous employment has been the subject of numerous policies in Australia, with governments aiming to increase the workforce participation rate amongst Indigenous people in recent years. Indigenous‐owned businesses, formally defined as businesses that are at least 50% Indigenous‐owned, have been demonstrated in previous research to maintain substantially higher levels of proportional Indigenous employment than non‐Indigenous businesses. This suggests that Indigenous‐owned businesses maintain work environments that are more supportive of and conducive to Indigenous employment, meriting the influence of Indigenous‐owned businesses' workplace practices in future Indigenous employment policy design. Using administrative data from two Indigenous business registries (Black Business Finder and Supply Nation), this paper provides an updated empirical analysis of the Indigenous business sector. This paper demonstrates that Indigenous‐owned businesses of all sizes, industries, locations and profit statuses consistently average proportional Indigenous employment rates higher than the Indigenous proportional population. Of all the people employed in Supply Nation‐listed businesses, over 35% are Indigenous. The potential impact of the Indigenous Procurement Policy is illustrated by differentials in the size of businesses and their capacity to employ Indigenous staff. This paper provides analysis of the Indigenous business sector that can inform future policy direction for both Indigenous employment and Indigenous business policies.

Abstract: It is dificult to argue with Hawke's contention that indigenous Australians have not benefited significantly from the previous industrial relations regime. Indeed, my original article documented the historical lack of articulation of indigenous interests within the system (Hunter 1997a). The aim of that article was to inform readers of the potential risks of the Workplace Relations Act 1996 for a disadvantaged group with little bargaining power in the labour market, rather than to argue that it would necessarily lead to worse outcomes. This rejoinder addresses Hawke's main arguments with that paper and reflects on the need for further research into one of the most disadvantaged sectors of the industrial relations system. Nevertheless, it concludes that the risks of exacerbating this disadvantage are palpable and the prospects for improving indigenous experience of employment in a more deregulated system are circumscribed.

Abstract: To date, the analysis of the reasons for the labour market disadvantage of Indigenous Australians has been constrained by the absence of longitudinal data on labour force status. This article uses the only extant large-scale longitudinal survey of the labour force outcomes of Indigenous Australians to analyse both labour market dynamics and the determinants of labour market success. The analysis reveals high rates of movements between labour force states by Indigenous Australians and that the Indigenous unemployed were around one-half as likely to move to employment over a 15-month period as were the non-Indigenous unemployed. The analysis presented in this article highlights the need for further longitudinal surveys of the labour market and social circumstances of Indigenous Australians.

Abstract: There is considerable conjecture about discrimination against Indigenous Australians in the workplace. This article is an exploratory attempt to systematically describe the overall differences in the industrial relations experiences of Indigenous and other Australian workers using data from Australian Workplace Industrial Relations Survey (AWIRS) 1995. There are several areas in which Indigenous workers particularly need active and informed representation within the industrial relations system and relevant statutory framework. The poor access to maternity aternity leave, the apparent lack of control over the working environment and the relatively high incidence of work-related injury and illness suggest that as a group, the needs of Indigenous people have not been seriously considered by either unions or policy makers.

Abstract: Recent research has identified a substantial increase in Indigenous mainstream employment since the mid-1990s, but there has been relatively little regional analysis of such employment. The aim of this article is to build on this previous research using the 2006 and 2011 censuses to provide a more disaggregated descriptive analysis of changes in the character of labour market outcomes for Indigenous Australians aged 15–64 years. One of the new findings in the article is that the employment of Indigenous youth (i.e. those aged 15–24 years) in remote areas is different from that of Indigenous youth in non-remote areas, but older Indigenous residents of such areas are not very different in employment terms. Policy-makers thus need to pay particular attention to Indigenous youth employment in remote areas because the failure to address these differentials may lead to a foreclosure of future labour market options. Policy also needs to facilitate Indigenous engagement in the mainstream economy by assisting Indigenous people to be work-ready, especially in ensuring that Indigenous skills are matched with employer demands, and expediting employment by informing businesses on how to provide an Indigenous-friendly workplace.

Abstract: The Workplace Relations Act 1996 attempts to expedite refom of the industrial relations system and increase the flexibility of workplaces seeking to compete in the international marketplace. This article provides a detailed guide to the legislation witb a particular focus on its likely impact on indigenous workers. Potential equity concerns arising from the operationalisation of the Act should be weighed against potential employment gains from improved macroeconomic perfomance or increased workplace flexibility. Unfortunately, tbe lack, of data on the articulation of the interests of indigenous workers within tbe industrial relations system limits the deptb of the analysis. Notwithstanding such shortcomings, the entrenched disadvantage experienced by indigenous workers means that they are unlikely to be in a position to avail themselves of any employment gains in the wider community.

Abstract: There have been a number of labour market programs that have attempted to increase rates of employment of Indigenous Australians by influencing job search behaviour. This paper provides the first ever baseline of data on the job search behaviour of Indigenous job seekers and how it compares to the job search of non-Indigenous job seekers. Clear differences between the job search behaviours of Indigenous and non-Indigenous Australians are apparent. Indigenous Australians rely disproportionately on friends and relatives as a source of information about jobs, although their networks tend to have less employed members, and therefore are less effective than non-Indigenous networks in securing employment. Non-Indigenous job seekers are also more likely to use more proactive search methods than are Indigenous job seekers.

Abstract: This paper provides a summary and overview of indigenous people within the Australian education system. A cohort analysis of changes in educational participation and the level and type of educational qualification over the last three censuses for the indigenous and non-indigenous populations is presented. The main finding is that although there have been some absolute improvements in indigenous educational outcomes over the period 1986 to 1996, relative to the non-indigenous there have been little if any real gains. The lack of improvement relative to the non-indigenous population occurs not only in the proportion of the population with post-secondary qualifications, but also in the proportion of indigenous teenagers staying at school. By any measure, the indigenous population remains severely disadvantaged. Another finding is that, for younger age groups, the non-indigenous population has a higher participation rate in post-secondary education than the indigenous population. This situation is reversed for older age groups.

Abstract: Research about the demand for Indigenous labour and the relationship of Indigenous workers to their employers is relatively scarce. Even less is known about Indigenous businesses. Supply Nation defines an Indigenous business as those where Indigenous stakeholders hold majority equity, but some researchers have argued that this definition could be relaxed to include businesses in which Indigenous people hold only half the equity in the enterprise. This article uses data from the Industry Capability Network Queensland, which has collected basic business information on a large number of businesses operating in Queensland. The findings reveal that Indigenous businesses have substantially better outcomes for Indigenous employment than non-Indigenous businesses – a result that holds even when the definition of Indigenous business is relaxed. The article also documents how Indigenous employment is concentrated in larger businesses, in particular industry sectors. Non-Indigenous micro-businesses employ relatively few Indigenous workers, and future research can usefully explore why this is the case. To understand the issues involved, it will be necessary to collect multi-level data that link detailed information on employers and employees (including a substantial s le of Indigenous workers).
