Professions, Professional Standards and Capital Markets in the 21st Century: Regulatory Engagement, Design and Strategies. This project aims to advance academic knowledge of professional obligation within capital markets. The objective is to develop practical mechanisms to test and validate oversight programs designed to advance professional standards within the established professions of law and audit and those who aspire to that status (financial advisers and broker/dealers). Re-inventing authority and integrity of primary legal sources for the online world, using free access to make the legal system more efficient and just. Authority and integrity of primary legal materials need to be reconsidered and re-invented in light of technological changes. This project will investigate and develop new best practices (policy, standards, technical) suited to the online environment and modern practices from both national and international perspectives.
Australian human rights complaints: Litigation, mediation or conciliation. This project will assess the effectiveness of the mechanisms used to resolve human rights complaints in Australia – conciliation, mediation and litigation. It will be the first project to evaluate the effectiveness of these mechanisms in a human rights context. Working with industry partners from the legal sector and four human rights commissions, this project will generate new knowledge on human rights complaints and on ....Australian human rights complaints: Litigation, mediation or conciliation. The presentation of expert evidence in Australian criminal trials: the role of lawyers and experts. This project will shed light on how courts, lawyers and experts can work effectively together to deliver expert evidence in the courtroom. Improving the provision and effective use of expert evidence will benefit the Australian community by providing a better quality criminal justice system.
Gauging informed public opinion on sentencing sex offenders: a national study. Sex offences appear to attract the greatest community condemnation and desire to punish, particularly when involving predatory stranger rapists or when the victims are children. This national study aims to ascertain informed public opinion on sex offender sentencing by exploring the views of jurors in sex offence trials in all higher courts in Australia.
How Much is it Worth? Legal Discourses and Everyday Understandings of Families, Work and Property. This project will analyse the extent of congruence between the legal discourses and everyday understandings of the contributions made by partners in married and unmarried relationships that form the basis for property division when relationships end. With the cost of a criminal jury trial running well in excess of $20,000 per day, policy-makers are keen to find ways of improving the efficiency of criminal trials. Museum of New and Old Art (MONA) and the social and cultural coordinates of urban regeneration through arts tourism. This project will analyse the extraordinary success of MONA (Museum of New and Old Art) as an art gallery and use this information to identify, stimulate and sustain innovative collaborations between MONA, the cities of Hobart and Glenorchy, and the state of Tasmania, aimed at maximising visitor numbers to the state from art related tourism.
Participation in the administration of justice: deaf citizens as jurors. This project will pioneer international research on legal signed language interpreting and jury service; the results are likely to innovate law reform. The expected outcome will be to overturn previously held common law that deaf people cannot serve as jurors due to having an interpreter as the 13th person in the jury room as well as confidentiality issues.
National registration of health practitioners: a comparative study of the complaints and notification system under the national system and in NSW. This project will compare the NSW healthcare complaints system with that of the new Australian Health Practitioner Regulation Agency to provide insight into complaints handling and notification at a state and national level. It will determine best practice in government assessment and resolution methods and reveal complainant experiences.
