Between social enterprise and social movement: responses to environmental change at the intersection of rights and regulation. It will significantly develop the foundations for designing effective governance structures to support ethically-motivated citizen initiatives.

A major policy objective of the Australian Government is to address the adverse effects of climate change on the Australian economy, natural resources and national security. This project will analyse the adequacy of the current international and Australian legal and policy frameworks to prescribe regulatory principles for ocean energy activities and ocean based climate change mitigation activities which both protect and preserve the marine environment and its resources from adverse impacts and equitably accommodate other uses of the ocean. Australian legislative approaches to regulating these activities will be analysed to identify regulatory gaps and options developed to enhance Australia's regulatory framework.Read moreRead less

The introduction of a national emissions trading scheme is the cornerstone of the Australian Government's response to climate change, the Carbon Pollution Reduction Scheme. The goal of this and other similar emissions trading schemes is the reduction of carbon emissions in the most cost effective manner. By promoting the harmonisation of the taxation treatment of permits on an international level, this project will promote the establishment of a uniform price for carbon and thereby support global initiatives to reduce emissions. Only a coordinated international response has the potential to reduce global emissions and therefore mitigate the impact of climate change on Australians and the Australian economy.Read moreRead less
Moving with dignity: a human rights approach to slow-onset climate change-related displacement and relocation in the Pacific. At the international, regional and national levels, climate change-related displacement poses a significant challenge to law and policymakers. This project examines potential legal responses to displacement resulting from slow-onset climate change and, in particular, the feasibility of en masse relocation of whole communities in the Pacific.

Cutting red tape around donations: A new model for deductible gifts. This project intends to simplify the categorisation of recipients of tax deductible gifts so that it is easy to give and receive gifts and so gifts go only to those organisations that are in keeping with public policy. Donations cost approximately $1.3 billion annually. It is therefore important that donation is a streamlined process that encourages social pluralism while ensuring there is a good use of public money. Research indicates that the current approach to determining donation deductibility status is complex and out of step with government policy, public discourse and community needs. The proposed framework will be simple, take into account public policy and be adaptable to the community’s changing needs and values.Read moreRead less
The Limits of maritime jurisdiction: overcoming uncertainties and safeguarding Australia's interests. Under the Fair Work Act 2009 (Cth), lawful industrial action may be taken by employees in support of collective bargaining, provided that they have first authorised the action in a secret ballot. This research project explores the effect of the statutory process by which a bargaining representative of such employees seeks permission from the Fair Work Commission to conduct a ballot. It will examine the impact of the ballot requirement and statutory process on decision-making by bargaining representatives and subsequent employee access to industrial action in order to understand the effect of the regulatory scheme on enterprise bargaining behaviour. It is the first empirical study of strike ballots, analysing an important public policy area.Read moreRead less
1989 and the rule of law revolution. This project explores three elements of the post-1989 worldwide rule of law revolution: constitutionalism, 'dealing with the past', and rule of law promotion. Australia increasingly seeks to promote the rule of law internationally, but these efforts draw on an inadequate base of knowledge and theory. This project work will expand that base.
