An empirical interdisciplinary study of the criminalisation of serious cartel conduct in Australia. Serious cartel conduct is seen as highly damaging to Australia's economic welfare but only recently has it been regarded as criminal. This research will inform public debate about the impetus and justification for this major shift in competition law policy and enforcement. It will provide robust empirical evidence about public opinion and business behaviour and derive insights into whether criminalisation will promote greater compliance with the law. It will assist in refining practical implementation measures to ensure the effectiveness of a criminal regime and it will aid legislators and regulators in policy-making, regulatory design and enforcement in relation to competition law and business regulation more generally.Read moreRead less

The project will enhance the capacity of the ACCC and other business regulators to ethically and effectively regulate to achieve the goals of regulatory policy such as a fair, competitive economy, occupational health and safety, and environmental integrity. Australia is already well recognised as a leader in ambitious empirical and policy-oriented social science research on regulatory compliance (through the ARC funded Governance Network including RegNet at ANU). This project will enhance that reputation with the most comprehensive data set on the corporate compliance impact of enforcement action and fundamental re-thinking of foundational theoretical questions about the nature and capacities of regulation.Read moreRead less

Counter-terrorism policing will be investigated by focusing on the impact of counter terrorism measures on the police, community, media and legislative/policy framework. An interdisciplinary approach is taken to the first ever examination of how counter terrorism is changing both the policing function and linguistically and culturally diverse communities. It will produce a counter-terrorism policing model that challenges traditional paramilitary responses to terrorism that centrally locates diverse communities/policing relationships at the heart of the counter-terrorism policing effort. With cross jurisdictional application, the qualitative and quantitative data, will inform a broad scholarship with wide ranging policy implications at both the state and federal level.Read moreRead less

The well-being of more than eight million Australian employees is underpinned by statutory workplace entitlements. For the large majority of those employees, these are set by federal legislation. The statutory entitlements are meaningful only in so far as they are complied with, and improving the effectiveness of the federal enforcement agency, the Workplace Ombudsman, is therefore of crucial public importance. This project provides the first comprehensive scholarly empirical evaluation of the Workplace Ombudsman. Its findings will identify multiple ways in which enforcement practices can be improved, not only for the Workplace Ombudsman, but also for comparable compliance agencies domestically and overseas.Read moreRead less
Forensic entomology and time of death estimation in Victoria. Assessing time of death is a notoriously difficult, yet critical component of homicide investigations. Assessing time of death is a notoriously difficult, yet critical component of homicide investigations. Forensic entomology can provide reliable death time estimates using detailed knowledge of the ecology and life-history characteristics of local carrion insect species. However, these data are largely unavailable for Victoria and elsewhere on the eastern Australian seaboard. This project will measure growth rates of carrion insect larvae, investigate carrion insect ecology in different habitats, and describe the larval morphology of key species. We will also investigate the efficacy of a new method for estimating time of death using corpse chemistry.Read moreRead less

As a major player in the maintenance of regional peace and security, Australia is increasingly using Australian Federation Police (AFP) in a range of international operations. The extent of deployments and the expectations both governments and communities place on these operations is unprecedented. This project, in collaboration with the AFP, will draw upon recent experiences to provide a clear legal framework, advancing the capacity for AFP deployments to maintain their high commitment to the rule of law. The project is of international significance and will consolidate Australia's reputation as innovative and influential in the planning, management and conduct of police in international operations. Improving the analysis of trace DNA samples in forensic science and human identification. The introduction of DNA technology into forensic science has revolutionised this profession, by generating a very high level of individual discrimination through genetic profiling. The introduction of DNA technology into forensic science has revolutionised this profession, by generating a very high level of individual discrimination through genetic profiling. However, there are still many crime scenes from which it is proving difficult to obtain sufficient DNA sample for such powerful profiling. This project will develop modifications to current techniques and procedures, as well as new novel approaches, to improve the targeting, collection, extraction and typing of trace amounts of biological samples. These results will significantly improve our ability to fight crime, especially high volume crime, act as a deterrent, and assist in disaster victim identification.Read moreRead less

Effective policing in Victoria depends upon sensitive relations with complex communities, but police experience persistent difficulties in implementing community policing strategies with the Australian Vietnamese community. Vietnamese residents call for police action and protection from drug and gambling-related crime. However, police find it difficult to build effective communication and co-operation with a community that seems reticent and lacking in trust. This project explores solutions to these problems, drawing on qualitative research on attitudes, experience of security and insecurity, institutional culture and cultural understandings amongst both police and community members. The nature and effectiveness of Australian regulatory responses to terrorism, the Esso Longford Explosion and the collapse of HIH Insurance. Industrial disasters, terrorist attacks and corporate collapses create increased demands by Australians for safety and financial security. This project will trace the effects of three such events on regulatory frameworks and compliance efforts by our airports, ports and major hazard facilities. It will ascertain whether regulatory reform following disasters does increase protection for Australians, or whether multiple and competing demands mean that significant gaps are created. This work will be an invaluable resource for investigators, regulators and policymakers charged with preventing corporate disasters and terrorist attacks. Read moreRead less

Since the implementation of random saliva tests for illicit substances in Victoria, 1 in 48 drivers intercepted have tested positive to the presence of methamphetamine. Because amphetamines have been reported to increase road crash risk, this finding highlights a significant road traffic problem. The proposed research will provide information on the most accurate saliva drug test to detect the presence of methamphetamine and MDMA in drivers, and will also provide data on the appropriate amphetamine cut-off level that relates to driving impairment. Accurate drug detection measures will result in better detection of drivers impaired by amphetamines, and in turn deter drivers from driving after consuming amphetamines.
