Abstract: The ‘object’ of 1tCO2e has become central to how we imagine the problem of climate change and its possible solutions. This chapter explores the complex relationship between international law and 1tCO2e an as ‘object’. It demonstrates the way in which international law plays a fundamental and constitutive role in defining, stabilizing, and protecting the ‘object’ of 1tCO2e. It shows that there is nothing ‘natural’ or ‘inherent’ in thinking about carbon as standardized, commensurable, substitutable, and exchangeable, but rather that the imaginary of carbon as a fungible ‘object’ is a mode of legibility structured by international law. Simultaneously, this mode of legibility has been the enabling precondition for the marketized form that international climate change regulation and governance has taken. As such, this chapter analyses how the ‘object’ of 1tCO2e is thus both the effect of and the enabling condition for specific modes of international legal regulation.

Abstract: The relationship between trade, investment, and environmental protection is complex, and environmental activists have engaged with international economic law in a wide variety of ways. Some environmental activists have sought to use trade systems as leverage to advance environmental protections aims, while others have been concerned about how international economic law constrains unilateral national environmental action. The dominant account of the harmonization of economic and environmental norms and the promotion of sustainable development through trade and investment is challenged by sobering statistics of ecological decline. In the face of intersecting ecological, economic, and social crises facing the global community, the often-marginalized critique developed by environmental justice activists of neoliberal globalization and the legal regimes that enable it is more urgent than ever. These perspectives and voices—which sometimes align with other environmental activists and sometimes directly oppose market-orientated environmental agendas—have been marginalized in the scholarship on international economic law, but offer an indispensable resource for imagining more equitable and ecologically just forms of global economic cooperation. This essay shows how environmental justice activists have enacted a powerful politics of refusal, resisting international economic law as well as articulating visions of how to achieve systemic change and sustainable societies based on environmental, social, economic, and gender justice and peoples’ sovereignty.

The Rights of Nature as a Legal Response to the Global Environmental Crisis? A Critical Review of International Law’s ‘Greening’ Agenda

Abstract: Over the past decade and a half, various natural entities have been recognised as having rights or legal personhood in certain domestic jurisdictions. The idea of nature as rights-bearing is seen by advocates to be a new and improved response to environmental threats. While rights of nature approaches are increasingly evident in transnational law, orthodox international law has yet to engage seriously with such approaches, despite increasing calls to recognise the rights of nature in international law. In this contribution we consider the potential and limitations of rights-based protections of nature as part of the ‘greening’ of international law. We argue that attempts to incorporate the rights of nature into international law need to be understood within the wider context and history of international law, including trajectories of colonialism and economic resource exploitation. Although rights of nature approaches may offer a path towards a greener international law, this path should not be followed in a way that reproduces problematic, homogenising aspects of international law, but instead centres human relationality with nature in place. Instead, we argue that there are important lessons to be learnt from transnational attempts to protect and implement rights of nature and legal personhood, especially where models are informed by Indigenous peoples’ relationships with nature.

Highlighting inequalities in the histories of human rights: Contestations over justice, needs and rights in the 1970s

Abstract: This article considers the ways in which concerns about economic equalities, both among and within countries, were taken up in human rights debates of the 1970s and how concerns about economic inequalities impacted on discussions about the possibilities, objectives and conceptions of rights. It shows how scholars and advocates from the global South, concerned about the production of underdevelopment and unequal accumulation, advocated a more ‘structural approach’ to human rights during this period that argued that a just international order was necessary for the realization of rights. The article first considers Third World demands for a New International Economic Order to address inequalities among countries, as well as the potentially conflicting focus on inequalities within countries by the World Bank and its subsequent promotion of a ‘basic needs’ approach to development. Thereafter, it considers how these different approaches to economic inequality were taken up in and influenced human rights debates and frameworks of this period.

Beyond Climate Due Diligence: Fossil Fuels, ‘Red Lines’ and Reparations

Abstract: The scale and scope of the climate crisis and its drastically worsening impacts means that even as a ‘climate due diligence’ obligation is increasingly taking shape as a dimension of human rights due diligence, there is also growing evidence of the limitations of this emerging norm. This article provides four critiques of climate due diligence based on its insufficiency, its conceptual ambiguity, its operational limitations, and its structural limitations. It argues that these critiques could be addressed by regulatory reform that draw clear ‘red lines’ based on the need to prevent the development of any new fossil fuel and address the ‘corporate capture’ of regulatory institutions by the fossil fuel industry. Additionally, it calls for reparations to ensure effective access to a remedy for existing and potential future climate-related human rights impacts that business has caused or contributed to.
