Abstract: Can the bisexual orientation in a marriage bond be considered a legal argument for formulating a verdict in the Indonesia Islamic courts? Does it have such a specific legal standing mentioned directly within any regulation covering the issue of Islamic private law? In answering both these questions, this article implements a normative-juridical inquiry that examines various rational possibilities in developing arguments of law. This article finds that in handling the case of bisexual orientation, the Indonesian legal system has remained a legal vacuum. Consequently, it seems it might not be a direct legal argument because it has no legal standing. This article argues that there is no single legal instrument has been imposed that explicitly mentions the case of the orientation. However, the judge may implement the analogous of the possibility of "adultery that leads to unresolved conflicts" to make a ratio legis of orce due to the orientation. AbstrakApakah orientasi biseksual dalam suatu ikatan perkawinan dapat dijadikan sebagai dalil hukum untuk merumuskan suatu putusan di pengadilan? Apakah ia memiliki kedudukan hukum tertentu yang disebutkan secara langsung dalam peraturan apa pun yang mencakup masalah hukum privat Islam? Dalam menjawab kedua pertanyaan tersebut, artikel ini menerapkan penelitian yuridis-normatif yang mengkaji berbagai kemungkinan rasional dalam mengembangkan argumentasi hukum. Artikel ini menemukan bahwa dalam menangani kasus orientasi biseksual, sistem hukum Indonesia masih mengalami kekosongan hukum. Akibatnya, seolah-olah tidak bisa menjadi argumentasi hukum langsung karena tidak memiliki legal standing. Artikel ini berargumen bahwa tidak ada satu pun instrumen hukum yang diberlakukan yang secara eksplisit menyebutkan kasus orientasi tersebut. Namun demikian, hakim dapat menerapkan analogi kemungkinan “perzinahan yang berujung pada konflik yang tidak terselesaikan” untuk membuat rasio logis perceraian karena orientasinya.

Abstract: This article examines whether a ‘civilizational turn’ has occurred among populist movements in Indonesia. It focuses on the civilizational elements in the populist discourse of the Front Pembela Islam (Islamic Defender Front/FPI) in Indonesia. The article traces the FPI’s history and growing influence on politics and society in Indonesia in the 2010s. This article argues that the FPI has instrumentalized religious discourse, and through it ided Indonesian society into three groups: the virtuous ummah, corrupt elites, and immoral internal and external non-Muslim enemies, especially the civilizational bloc ‘the West’. This instrumentalization gained the group a degree of popularity in the second decade of the post-Suharto period and strengthened its political power and ability to bargain with mainstream political parties. The article uses the FPI’s actions and discourse during the Ahok affair to demonstrate the civilizational turn in Indonesian populism. The article shows how the FPI grew in power during the Ahok affair, in which a Christian Chinese politician, Basuki Tjahaja Purnama, was accused of blasphemy by Indonesian Islamists and later convicted on the same charge by an Indonesian court. The FPI was a leading part of a broad coalition of Islamist groups and in iduals which called for Ahok to be charged with blasphemy charges which were eventually laid and which led to Ahok being sentenced to two years imprisonment. The FPI, the article shows, framed Ahok as a non-Muslim Christian and therefore a ‘foreign’ enemy who was spreading moral corruption in Indonesia, governing ‘elites’ as complacent in combating immorality and positioned themselves as defenders of ‘the people’ or ummah. From the security perspective of the state, the FPI presented a critical threat that required containing. As a result of the growing power of the group, the FPI was banned in 2020 and Rizieq was imprisoned, while Ahok was politically rehabilitated by the Widodo government. Although the FPI’s banning is considered the most effective nonpermanent solution for the state, there is evidence that the FPI’s discourse has been adopted by mainstream political actors. This article, then, finds that the growth of the FPI during the second decade of the post-Suharto period, and their actions in leading the persecution of Ahok, demonstrates a civilizational turn in Indonesian Islamist populism.

Abstract: This article purposes to analyze and discuss the Hamka's neo-Sufism idea. It is related and contextualized to various problems that emerge in modern society, especially capitalistic industrialization, and hedonistic culture. This article states that Hamka's neo-Sufism aims to find true happiness and transcendence (ma’rifatullah). Through the practice of Hamka's neo-Sufism, it will protect a Muslim from all temptations for the interests of the accumulation of wealth and the pleasures of worldly life. Neo-Sufism persistently strengthens the spiritual quality of a Muslim, making one always aware of when dealing with changing life contexts.

Abstract: This paper evaluates Muhammadiyah’s effort to revitalise the doctrine of Siyar since the publication of Negara Pancasila sebagai Dār al-‘Ahd wa al-Shahādah (the state of Pancasila as the abode of covenant and the space of testimony). It finds that the ideas in the publication aim to provide guidance for Muhammadiyah members on the relationship between the state and Muhammadiyah. It ensures that its members will understand that Indonesia is dār al-‘ahd wa al-shahādah. It seeks to defend itself against Islamist criticism, while also affirming its responsibility for state development. This paper argues that the idea is a product of Muhammadiyah’s contemporary ijtihad, an effort in theologising democracy based on the idea of Islam Berkemajuan (Islam with progress), in order to strengthen the social bonds of its members who are facing the challenging reality of the massive spread of Islamism and the associated social, political and economic problems.

Abstract: This paper evaluates the larger pattern of American interest in the Arab Gulf. It questions whether the pattern is based on ideological or economic interest. It also critically examines various data and interprets following their (data) social, economic and political interlinks and special topics that have been significantly proposed in the state policy. This paper argues that the US foreign policy represents two larger directions of its interest: economy and ideology. Both have linked together and interrelatedly have determined and have been determined by strategic culture of the states in the region and its complexities covering all national, interstate, regional, broader regional (Middle East) and global levels. This paper also arguably states that there is no single interest that can be oversimplified, but it has remained highly dynamic or has demonstrated multiple complexities of the interest in which they are represented by issues of oil, war on terrorism, nuclear weapon and Israel.

Abstract: This article aims to examine the interaction between social science and tradition in Malay-Indonesian scholarship, with a particular focus on the perspectives of Muslim intellectuals. This interaction is represented by two approaches: autonomous social science and prophetic social science. The article argues that both approaches have their distinct inclinations in perceiving and formulating theoretical foundations. These inclinations are shaped by their unique qualities, alternative values, intellectual stances, and thinking styles. Moreover, during the process of development, they are influenced by various factors that give them their distinct characteristics, such as autonomy, a problem-based approach, and a strong commitment to rethinking society and driving change and transformation. The social concept of Islam Nusantara represents this development. It is a collection of arguments and practices of Islam adopted by Muslims in Nusantara, which have shaped patterns of social relations and cohesiveness through communicative actions throughout a specific historical epoch in the region. The article also highlights two essential factors that significantly shape these approaches: the dominant schools of thought in social science and the peculiar Malay-Indonesian traditions. While Western social sciences have played a central role in understanding certain concepts, Malay-Indonesian traditions have contributed significantly to shaping the paradigm of local scholars.

Abstract: This paper tries to diagnose the vision of Islamic Cosmopolitanism toward the circle of Young Intellectual Muhammadiyah Network (JIMM). Through the perspective of social diagnose of the tradition of Mannhemian sociology of knowledge, it finds that JIMM has their own intellectual stand amongst some humanity discourses and ideas such pluralism, multiculturalism, bhinneka nationalism and cosmopolitanism. Elaborations among these discourses and ideas are played in order to serve the sense of social justice and humanity, as well as human dignity in the world. These elaborations are dakwah efforts that want to be a winner in the midst of global civilization constellation. However, in these attitudes, JIMM has foundation of thought which is interpreted into three ways, are: progressive Islam, social liberation, and historical activism. In dealing with very different context of Muslim societies in the contemporary time, Islamic Cosmopolitanism of JIMM attempts to fulfill their mission through the agenda of internationalization Islam berkemajuan and Indonesian Islam.

Abstract: The TELE-critical Care verSus usual Care On ICU PErformance (TELESCOPE) trial aims to assess whether a complex telemedicine intervention in intensive care units, which focuses on daily multidisciplinary rounds performed by remote intensivists, will reduce intensive care unit length of stay compared to usual care. The TELESCOPE trial is a national, multicenter, controlled, open label, cluster randomized trial. The study tests the effectiveness of daily multidisciplinary rounds conducted by an intensivist through telemedicine in Brazilian intensive care units. The protocol was approved by the local Research Ethics Committee of the coordinating study center and by the local Research Ethics Committee from each of the 30 intensive care units, following Brazilian legislation. The trial is registered with ClinicalTrials. gov (NCT03920501). The primary outcome is intensive care unit length of stay, which will be analyzed accounting for the baseline period and cluster structure of the data and adjusted by prespecified covariates. Secondary exploratory outcomes included intensive care unit performance classification, in-hospital mortality, incidence of nosocomial infections, ventilator-free days at 28 days, rate of patients receiving oral or enteral feeding, rate of patients under light sedation or alert and calm, and rate of patients under normoxemia. According to the trial's best practice, we report our statistical analysis prior to locking the database and beginning analyses. We anticipate that this reporting practice will prevent analysis bias and improve the interpretation of the reported results.ClinicalTrials.gov registration: NCT03920501.

Abstract: contemporary literatures that had been produced by Muslim and non-Muslim scholars and intellectuals, ranging from Muslim and Western countries. With the progressive perspective of multiple modernities and intercivilisational approach, this paper argues that the concept of Ummah should be interpreted as a modern concept of inclusive cosmopolitan-humanitarian solidarity that emphasise values of liberalism, pluralism, democracy, human rights and sustainable development. This concept has been also strengthened by a sociological representation of the tradition of Islam Nusantara. Its relative historical continuity in the process of the development of the micro sociological dimension of tradition, it explains that this concept of Ummah is not rootless. Consequently, it can be understood that its applicability is relatively possible . Paper ini ingin mengelaborasi wacana pembangunan konsep Ummah yang digali dari pelbagai literatur kontemporer, baik yang berasal dari para sarjana dan intelektual Muslim maupun non-Muslim, baik itu yang berasal dari negara-negara Muslim maupun Barat. Melalui perspektif multiple modernities dan pendekatan lintas-peradaban, paper ini berargumentasi bahwa konsepUmmah sangat perlu kiranya ditafsirkan dan dipahami sebagai konsep modernmengenai solidaritas kemanusiaan yang inklusif dan kosmopolitan. Konsep inimenekankan pentingnya nilai-nilai seperti liberalisme, pluralisme, demokrasi,hak asasi manusia dan pembangunan yang berkelanjutan. Adanya tawaranmengenai konsep ini, didukung oleh representasi sosiologis dari praktik IslamNusantara. Praktik Islam Nusantara tersebut, menunjukkan adanya kontinuitashistoris dalam proses pembangunan tradisi, yang berlaku di dalam dimensisosiologis yang bersifat mikro. Hal ini tentu saja juga menunjukkan bahwakonsep Ummah ini bukanlah hal yang tak berakar dalam realitas kehidupanMuslim. Dengan demikian dapat dimengerti bahwa, penerapan konsep Ummahini sangatlah memungkinkan.

Abstract: This article focuses to examine the process of Muhammadiyah’s ijtihād has evolved, specifically in constructing the notion of Negara Pancasila sebagai Dār al-‘Ahd wa al-Shahādah (the state of consensus and witness) and the arguments on which it is built. The scholarly issues that have been highlighted in this article are study on this specific discourse has not been done yet, the ijtihad in the field of Siyar (law of war and international relations in Islamic traditions) which has been elaborated with ideas of contemporary social sciences is very rare, and the discourse of Siyar has dominantly covered only the area of Middle East. Accordingly, this article confidently fulfils these gaps applying qualitative research method and analysis of social contextualisation. This article argues that the way of Muhammadiyah’s ijtihād in producing the idea of Indonesia as the state of consensus and witness is applying theologising democracy. It consists of trajectory in which Muhammadiyah has objectified Islam and substantialised it to enhance the meaning of democracy.

Abstract: This article purposes to evaluate the phenomenon of domination of combative jihadism and factors that have conditioned the domination. It also evaluates whether the dominant concept of jihād can be paralleled to the Western concept of “just war”. It can be argued that normatively Islam recognises two forms of jihād namely the greater jihād (self-purification and improvement) and the lesser jihād (combative war). Historically, the contemporary discourse of jihād has been dominated by its combative meaning, however. This domination has been conditioned by several factors, such as the growth of the ideology of radical Islamism, the Western hegemonic behaviour, globalisation and the absence of alternative narratives. This article finds that, furthermore, the dominant concept of jihād, in a legalistic view, is relatively similar to the Western concept of just war, although, in reality, it tends to be illegal or “breaking the law”. It discusses the normative and historical meanings of jihād, the factors that have been conditioning the domination of combative jihadism, and jihād and just war.

Abstract: Indonesia, as one of the largest majority Muslim countries, has had a consistent stance on the Israel-Palestine conflict since its inception. Despite the general pro-Palestinian stance, this article explores the discourse of three significant leaders of the Indonesian people - Soekarno, Abdurrahman Wahid and Ahmad Syafii Maarif. As presidents of Indonesia of different time periods of Indonesia, Soekarno and Wahid tended to be pragmatic in their articulation of their political stances, though it is articulated in different ways. Maarif, as the leader of Muhammadiyah, a popular non-governmental organisation on the ground, was more idealistic and concerned with anti-Zionism. This article highlights that the different nuances of the three leaders is due to their different capacities as leaders, their social and political contexts, and the intellectual leanings and experiences.

Abstract: This paper aims to examine the position of ummah while Muslims are living as minority in Australia. This paper argues that Australia as a secular and multicultural state has supported the development of ummah. There are some reasons to deal with this argument: first, the state consistently protects, respects and fulfils the right to the freedom of religion of all citizens because it ratified some international human rights documents second, the state administrators have shown their professionalism in their daily life activity in terms of implementing the state law enforcement third, although there are minor cases of religious discrimination that have been imposed by a minority group of fundamentalist Christian, they can be mitigated through the larger involvements of Muslims in the process of social development such as organising interreligious dialogues, discussions on religious tolerance, which significantly has been conditioned by the societal context of multiculturalism in Australia fourth, a Muslim intellectual in Australia is totally pro-human rights.
